This law will effect everybody specialized in traditional collecting fields, such as books, stamps, furniture, ceramics, coins, classic cars and paintings. Retroactively, this new law will impose due diligence guidelines that are impossible to follow even for the most meticulous collector. When it comes to a dispute, the law will require, by reversing the burden of proof, the owner of a “cultural good” with a value of at least 2,500 euros to provide proof as to the item’s provenance for the previous 20 years; this affects “archaeological cultural goods” with a value as low as 100 euros. This is an unrealistic demand which misrepresents most of the objects that are currently traded on the domestic and the international art market in full accordance with the law as being illegal, and will result in a considerable decline in value of the objects in question. We therefore demand a law on the Protection of Cultural Heritage that observes the following principles: • No retroactive effect of the law • No reversal of the burden of proof • A clear definition of the term “national cultural heritage” and a limit to claims by the state to “national cultural heritage” only • Free movement, unimpaired by bureaucratic obstacles, of cultural goods which are not classified as “natural cultural heritage”, EU-wide, according to the free movement of goods • An appropriate participation by the parties representing collectors and dealers in the law-making process For centuries collectors have protected cultural heritage. Private collecting adds to national efforts and promotes the tradition’s preservation in all its variety, in a way museums alone could never accomplish. Collecting is an immaterial cultural heritage that is currently threatened by the latest drafts of the new German law on the Protection of Cultural Heritage. In the name of all signers.

It will be articulated to the members of parliament in any case. But the 120,000 must be residents of Germany in order to get a statement from the parliamentarians. Regardless to that every vote coming from outside enhances the political weight as well. This lets our parliament and our society know that people from all over the world are monitoring there decisions. The more votes are collected, the more interesting it is for newspapers & magazines to make that problem public. Until now the commision tried to develop the law "under the public radar". The main issue is, that we have to make this petition public all over the globe and activate as many collectors as possible (from various collecting fields, not coins only as stated out before)... This exactly is what I am trying to say. Prevent other governments of western countries in preparing similar plans

Many thanks for your post. Most likely that the case of Gurlitt had an impact on this. Still that law proposal will destroy collecting of common people, serving particular interests of fundamentalist archaeologists. I doubt that it would help to rescue cultural heritage and more important to enhance public interest in cultural heritage.

Dear Rob. There is no doubt, that you are an educated and reflective person. But I think you are trapped in that kind of conservative thinking. I have to hear and read that kind of information every day articulated by my own government. And most of these political parties are trapped in the same pitfall. The labour party (SPD) does deserve this name any more, she is as conservative as the party of Angela Merkel (CDU) in my view. To make it clear, the monetary system with credit money including the highly speculative banking sector will cost us (as a society) much more than the social system ever did. The social insurance is a part of payment for the working people. Integrating the DDR was paid by pillaging the public pension funds BTW! To say it again: The last decades, governments cutted down peoples life standard and salary several times. These people continuously had to pay more money for lesser quality. The wages (including social & public service) were cut down, but the financial situation (not only in Greece) became worse. The benefits of the cuttings were transfered to banks, fonds, investors & share holders. If this continues we all will have Greek conditions soon.
